3.2 We endeavour to provide accurate menu information, pricing, specials and availability; however, errors may occur. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders at any time without prior notice.
3.3 You agree to provide valid and correct information when placing an order. We reserve the right to refuse or cancel orders in our discretion.

4. Disclaimer of Warranties

5. Limitation of Liability

5.2 OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SITE OR USING ANY SERVICES PROVIDED THROUGH THE SITE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

You agree that any legal action or proceeding arising out of or related to your use of the Site shall be brought exclusively in the federal or state courts located in Orange County, Florida, and you consent to personal jurisdiction in those courts.

12. Waiver & Severability

12.1 No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
12.2 If any provision of MapQuest+1these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or terms referenced herein, constitute the entire agreement between you and us regarding your use of the Site, superseding all prior or contemporaneous communications, proposals or representations (whether oral or written) between you and us.
